Terms of service

Acceptance

By creating an account or using the Yachtxchange website or mobile apps (the “Service”), you agree to these Terms. If you don't agree, don't use the Service.

Who can use the Service

You must be at least 18 and able to form a binding contract. Brokers using the broker portal further confirm they have the authority to act for their brokerage. Private sellers using the free “List Your Boat” flow confirm they own the vessel they list or have the seller's written authority.

Your account

You are responsible for everything that happens under your account, including any subscription charges and listing actions. Don't share credentials. Notify support@yachtxchange.app immediately if you believe your account has been compromised.

Listings, photos, and content

  • You retain ownership of the photos, descriptions, and other content you upload (“Your Content”).
  • You grant Yachtxchange a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and create previews of Your Content so we can operate the Service and syndicate listings to partner surfaces you opt into.
  • You represent that Your Content is yours to upload — you own it or have explicit licence from the rights-holder, and its publication doesn't infringe anyone's rights. Manufacturer-issued press photos and third-party brokerage photos are not permitted without written permission.
  • You will not upload illegal, deceptive, obscene, or harassing content; you will not impersonate any person or vessel; you will not list a vessel you do not have authority to sell.

Conduct on the platform

  • Do not harass, threaten, or defraud other users.
  • Do not scrape, copy, or republish other users' listings, photos, or contact information.
  • Do not attempt to bypass platform fees, redirect transactions outside the platform to avoid commission, or use the Service to circumvent another broker's exclusive agreement.
  • Report abuse via the in-app report flow or support@yachtxchange.app. We may suspend or terminate accounts that violate these Terms.

Free and paid features

Private sellers can publish up to three listings at no charge. Broker subscriptions, AI-credit overages, and similar paid features are described in the relevant in-product upgrade or billing surfaces. Prices, limits, and features may change with advance notice; existing subscription terms continue through their current billing period.

Subscriptions and cancellation

  • Broker subscriptions auto-renew at the cadence shown at purchase until cancelled.
  • You can cancel at any time from the broker portal's Plan & Billing screen. Cancellation takes effect at the end of the current billing period.
  • Refunds are not issued for partial periods except where required by law.
  • Subscriptions purchased through the Apple App Store or Google Play are managed through your store account; we cannot issue refunds for store-billed subscriptions.

Yachtxchange is not a party to the sale

We provide tools for brokers and sellers to list vessels and for buyers to find them. We are not a broker, escrow agent, or party to any transaction between users. Pricing, availability, condition, sea-trial logistics, financing, and closing arrangements are handled directly between buyer and seller. Verify everything before sending funds.

AI features

The listing copilot, concierge, matchmaker, and other AI features generate output from probabilistic models. Results may contain errors. Always review AI-generated descriptions, prices, and recommendations before publishing or acting on them. You remain responsible for the listings and communications you submit.

Intellectual property

The Yachtxchange name, logo, website, and software are our property. These Terms grant you no rights in our trademarks, source code, or design system beyond using the Service as intended.

Termination

You can close your account at any time from the Account screen in the mobile apps or the Settings page in the broker portal. We may suspend or terminate accounts that violate these Terms, including for fraudulent listings, duplicate-photo abuse, or harassment. Termination doesn't entitle you to a refund for an unused subscription period.

Disclaimers and liability

The Service is provided “as is” without warranties of any kind to the maximum extent allowed by law. Yachtxchange's aggregate liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for losses related to the sale, condition, or financing of any vessel listed on the Service.

Governing law

These Terms are governed by the laws applicable to the entity operating Yachtxchange, with exclusive venue as set out in our signed customer agreement (for paying brokerages) or in the registration country of Yachtxchange (for all other users). Nothing here waives consumer rights you have under your local law.

Changes

We may update these Terms. We will notify you in-app and by email of material changes at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
